Terms & Conditions
The following points will apply before, during and after the cooperation between customer and IM NOMADE, it is important that you read our terms and conditions carefully.

1. Right of use
Once the final payment has been made, the client will have the right to use the delivered elements as the client pleases. Although, IM NOMADE do politely ask that you don’t change or manipulate any of the assets provided to the client.
1.1 Third party
1.1.1 IM NOMADE remains at all times the creator of the delivered elements, therefore the client does not have the right to resell the creations to third parties. Also, the client does not have the right to name the creations as self-created.
1.1.2 IM NOMADE does not have the right to reuse the personally created elements for a third party.
1.2 Use of social media & portfolio
IM NOMADE has the right to use the creations for portfolio and for the use of social media. IM NOMADE will respect the client, in this and not bring their brand to shame.
2. Product Delivery
Upon receipt of the final payment, IM NOMADE will share the project elements and the accompanying guides and videos to help the client take over the project and possibly maintain it himself.
3. Correction rounds
3.1 Website design correction rounds
3.1.1 IM NOMADE offers 3 rounds of correction within the website template design process. Within these rounds, the client has the right to freely share (with respect) his feedback with us without a limit of feedback.
3.1.2 If the client needs more than 3 correction rounds, IM NOMADE will charge this. Starting with an amount of €100, – EXCL VAT
3.1.3 When the website template design has been approved by the client, it is no longer possible to adjust the design. If the client needs this, the process of the design will be redone and the necessary costs will be calculated.
3.2 Website development & design
3.2.1 IM NOMADE offers 2 rounds of correction within the website development, the client has the right to request minor design changes without changing the entire design.
3.2.2 the client does not have the right to make a design request in which the design changes completely. If the client needs this, the process of the design will be redone and the necessary costs will be calculated.
3.2.3 IM NOMADE will do the necessary test rounds to ensure that everything in the website functions optimally for both desktop and mobile.
3.3 Branding
3.3.1 M NOMADE offers 3 rounds of correction within the branding design process. Within these rounds, the client has the right to freely share (with respect) his feedback with us without a limit of feedback.
3.3.2 If the client needs more than 3 correction rounds, IM NOMADE will charge this. Starting with an amount of €100, – EXCL VAT
3.3.3 When the branding has been approved by the client, it is no longer possible to adjust the design. If the client needs this, this will be considered a rebranding and IM NOMADE will charge.
4. Refund Policy
IM NOMADE will not issue a refund at any time. Should the project stop earlier for whatever reason, IM NOMADE charges for the hours worked between the first payment and termination of the contract, the client may not pay the full amount.
5. Payment
IM NOMADE will at the beginning send an invoice for 50% of the total amount of the project, IM NOMADE will only start the project when the first payment has been received and the contract has been signed.
When the project is completed, IM NOMADE will send the remaining amount and the project will be considered completed.
5.1 Non-refundable deposit
If the start date of the project is 1 month after the contract date, IM NOMADE requires a Non-refundable deposit of 10% of the project. This so that the client is sure that the planned project cannot be forgiven by others.
5.1 Late payment
All invoices from IM NOMADE have a 30-day payment term, if the client for whatever reason cannot pay this within 30 days, the client must indicate this 2 weeks before the end of the payment date. IM NOMADE will extend the date once the payment term by 30 days.
After 30 days of outstanding payment, IM NOMADE reserves the right to send you to collections, upon which you will owe the total amount of any outstanding payments plus any collection costs, including reasonable attorney’s fees.
6. Confidential Information
Each party acknowledges that in connection with this Agreement it may receive certain confidential or proprietary technical and business information and materials of the other party, including without limitation Preliminary Works (“Confidential Information”). Each party, its agents, and employees shall hold and maintain in strict confidence all Confidential Information, shall not disclose Confidential Information to any third party, and shall not use any Confidential Information except as may be necessary to perform its obligations under the Proposal except as may be required by a court or governmental authority. Notwithstanding the foregoing, Confidential Information shall not include any information that is in the public domain or becomes publicly known through no fault of the receiving party or is otherwise properly received from a third party without an obligation of confidentiality.
7. Miscellaneous Terms
You agree to indemnify and hold IM NOMADE harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the templates or creation. IM NOMADE & Nomade Templates reserves the right to change the Terms of Service without notice. Further, IM NOMADE reserves the right to modify or discontinue any portion of the membership. IM NOMADE shall not be liable to the client or any third party should IM NOMADE & exercise its right to modify, suspend, limit or discontinue any feature of its products or services. Use of the templates or creation and this website shall be governed by and construed in accordance with the internal laws of the EU. You agree to submit to the non-exclusive jurisdiction of any EU State Court, in any action or proceeding arising out of or relating to the use of this website or templates\ creation. If any provision of the Terms of Service is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect.
